NFA Item Categories
The National Firearms Act (1934) regulates these classes of firearms and devices. Each requires ATF registration and a $200 tax stamp (except AOW transfers at $5).
Suppressors / Silencers
Devices that reduce the report of a firearm. Legal in 42 states with a valid ATF Form 4 tax stamp. $200 stamp fee applies.
Short-Barrel Rifles (SBR)
Rifles with a barrel under 16 inches or overall length under 26 inches. Regulated under the NFA with a $200 stamp.
Short-Barrel Shotguns (SBS)
Shotguns with a barrel under 18 inches or overall length under 26 inches. $200 NFA stamp required.
Machine Guns
Pre-1986 transferable machine guns are legal for civilians with ATF approval. $200 stamp. Registry closed — expect high prices.
Destructive Devices
Includes grenade launchers, explosive devices, and large-bore weapons over .50 caliber. $200 stamp and strict ATF oversight.
Any Other Weapons (AOW)
Includes pen guns, wallet guns, and certain pistol configurations. $200 stamp to make, $5 stamp to transfer.
Suppressors Are Legal in SC
South Carolina is a suppressor-friendly state. There is no additional state registration on top of the federal NFA process. Once your ATF Form 4 is approved and your tax stamp arrives, you can legally possess and use your suppressor in South Carolina.
Suppressors may be used for hunting in South Carolina. Many hunters use them to reduce noise pollution and protect hearing while still hunting legally on private and some public lands.

Choose Your Transfer Structure
Decide whether to purchase as an individual or through an NFA trust. A gun trust allows multiple trustees. Consult an attorney if unsure.
Submit ATF Form 4
Complete the ATF Form 4 (Application for Tax Paid Transfer). Individual buyers also submit fingerprint cards and passport photos. The $200 tax stamp fee is paid at this step.
ATF Review Period
The ATF reviews your Form 4. Current wait times are approximately 6–12 months for most applicants. The item stays with the seller's dealer during this period.
Approval & Pickup
Once your Form 4 is approved and your tax stamp arrives, the seller's FFL ships the item to your local FFL dealer (or Trigger Transfers for local SC pickups). You take possession after final transfer paperwork.
Should You Use an NFA Gun Trust?
A gun trust (also called an NFA trust or revocable living trust) is a legal entity that owns NFA items instead of an individual. Multiple "trustees" can legally possess the item under the trust.
After the 2016 ATF Rule 41F, responsible persons of a trust must still submit fingerprints and photos with Form 4. But a trust still offers advantages, especially for estate planning and shared ownership.
